Terms of Use
Purpose
These Terms of Use (“Terms”) define the conditions for accessing and using the Elysium Care platform, an intelligent patient follow-up SaaS solution, published by MEDS-LINK Ltd (Elysium MedTech brand).
Acceptance
Accessing and using the platform implies full and unreserved acceptance of these Terms. Failing acceptance, the user must refrain from using the service.
Service Description
Elysium Care is a platform supporting post-operative and patient follow-up: adaptive questionnaires, AI-assisted alerts, and automatic generation of medical reports for healthcare professionals.
Access and Accounts
Access to the platform is reserved for healthcare professionals and medical establishments that have subscribed to an Elysium Care plan. Each user is responsible for the confidentiality of their credentials and for any activity carried out under their account.
Health Data and HDS Hosting
Health data processed via the platform is hosted in France on HDS-certified (Health Data Host) infrastructure, in accordance with Article L.1111-8 of the French Public Health Code. MEDS-LINK Ltd acts as a data processor within the meaning of the GDPR, on behalf of the healthcare professional acting as data controller.
Intellectual Property
The platform, its components, code and content are the exclusive property of MEDS-LINK Ltd / Elysium MedTech. The subscription grants a personal, non-exclusive right of use, without transfer of ownership.
User Obligations
The user undertakes to use the platform in accordance with its intended purpose, applicable regulations and medical ethics, not to compromise the security of the service, and to enter only lawful and accurate data.
Availability and Maintenance
MEDS-LINK Ltd makes reasonable efforts to ensure the availability of the service. Interruptions may nevertheless occur for maintenance, updates or in the event of force majeure, without the publisher's liability being engaged.
Liability
Elysium Care is a medical follow-up support tool. It does not replace the clinical judgement of the physician and does not constitute a medical act. The practitioner remains solely responsible for all medical decisions made.
Modification of the Terms
MEDS-LINK Ltd reserves the right to modify these Terms at any time. Users are informed of any substantial change; continued use constitutes acceptance of the updated Terms.
Termination
The subscription may be terminated under the conditions agreed between the parties. In the event of a serious breach of these Terms, access to the service may be suspended or terminated. Upon the end of the relationship, data is processed in accordance with the privacy policy and the legal obligations applicable to health data.
Applicable Law and Jurisdiction
These Terms are governed by the law applicable at the publisher's registered office. Any dispute shall be submitted to the competent jurisdiction, subject to applicable mandatory legal provisions.
